Absent any federal climate change policy, states and interest groups are turning to the courts. More than two dozen cases already are pending, pursuing legal strategies ranging from the Clean Air Act, Endangered Species Act, energy statutes, National Environmental Policy Act and similar state laws, and common tort law. And the number of suits grows daily.
